TREE TRIMMERS

5-1601 Application of Chapter 5-100. The provisions of Chapter 5-100 shall apply to the issuance of licenses hereunder.

5-1602 Exclusion. The requirements of this Chapter shall not apply to licensed contractors cutting trees in connection with a City-ordered public improvement contract.

5-1603 Definition. “Tree” is defined as a woody perennial plant, usually with one (1) main stem or trunk and many-branched, which has a diameter of greater than two (2) inches when measured at a point four (4) feet above ground level.

5-1604 Felling Trees on Boulevards. No person shall fell any tree located within a public right-of-way, nor engage anyone to do the same, without having first secured a written permit from the City forester.

5-1605 License Required. No person shall engage in the business of felling, cutting, or trimming trees for hire without having secured a license.

5-1606 Application. In addition to such information as the City Clerk may require pursuant to Section 5-102, the application shall also include:

(1) The number and names of the employees of the applicant.
(2) The number of vehicles of the applicant, together with a description and the license number of each.
(3) The type of equipment proposed to be used.
(4) The method and place of disposal of waste materials.

5-1607 License Fee. The fee for the license shall be established from time to time by ordinance of the City Council. 5-1608 Insurance Required. No license shall be issued nor be effective until the applicant has filed with the City Clerk a commercial general liability insurance policy issued by an insurance company authorized to do business in Minnesota, covering all operations of said applicant under this Chapter in the amounts of at least $1,000,000 per occurrence and $2,000,000 general aggregate. Said policy shall provide that it may not be canceled by the insurer except on ten (10) days written notice to the City Clerk. If such insurance is canceled and the licensee shall fail to replace the same with another policy conforming to the provisions of this Chapter, said license shall be automatically suspended until such insurance shall have been replaced. 5-1609 Identification. At the time a license is issued, the applicant shall be furnished with an identification tag for each vehicle listed in Section 5-1604, such tags to show thereon the license number, the name of the City, the date the license expires, and the words “tree trimmer.”
