5-2500  Event Parking Permits

SPECIAL EVENT PARKING LOT PERMITS

5-2501 Permit Required. No person, firm, partnership, association or corporation may use any property in the City for a commercial parking lot except as provided by this Chapter or authorized by other laws or provisions of this Code. For the purposes of this chapter “commercial parking lot” means the parking of motor vehicles in exchange for compensation.

5-2502 Issuance of Permit. Notwithstanding any other provisions of this Code, the Zoning Administrator, with the concurrence of the Police Department, may issue permits for the operation of commercial parking lots in conjunction with special events. Permits shall only be issued to individuals.

5-2503 Application. Applications for permits under this Chapter shall be made to the Zoning Administrator on forms provided by the City at least one week before the day the permit is to take effect.

5-2504 Conditions of Permit. Permits shall be subject to the following conditions:

(1) The parking lot must be in conjunction with a special event.
(2) No vehicles may be parked on a public street or within a public right-of-way.
(3) No person may be located on a public street or within a public right-of-way for the purpose of attracting attention to the parking lot.
(4) All entrances to and exits from the parking lot shall be by way of previously established drives and access points.
(5) Grass and other similar organic materials located in the area where vehicles are parked shall be kept mowed to a height not exceeding that of a typical residential yard.
(6) The applicant or a representative of the applicant must be on the site at all times that customers’ vehicles remain on the property.
(7) The applicant shall be responsible for the restoration of the property following the event.

5-2505 Limitations of Permit. The maximum length of any permit will be seven consecutive days. No more than one permit may be issued to the same location during any calendar year regardless of the length of that permit.

5-2506 Signs.

(1) One sign not exceeding 32 square feet in area must be provided at each entrance to the property.
(2) The sign must conspicuously display in numbers not less than eight inches high the parking charge per vehicle.
(3) A copy of the permit must be attached to a required sign.
(4) Signs may not be located within a public right-or-way.
(5) No other signs related to parking for the event may be located on or off the property.
(6) All signs must be removed from the property the day following the last day of the permit.

5-2507 Applicant’s Responsibilities. The applicant shall be responsible for complying with the provisions of this Chapter. The applicant shall also bear the sole responsibility for any claims for damages or injuries that may arise as a result of operating a commercial parking lot pursuant to this Chapter.

5-2508 Permit Fee. The permit fee shall be established from time to time by ordinance of the City Council and shall accompany the application. The fee will be refunded if no permit is issued. [Revised 3/1/05, Ordinance 1868]

5-2509 Violations.

(1) A violation of any of the provisions of this Chapter is a misdemeanor.
(2) In addition, any member of the Police Department, with the concurrence of the Zoning Administrator or designee, may cancel any permit issued under this Chapter upon a second violation of any applicable law or ordinance. Notice of the cancellation shall be in writing and shall state the reasons for the cancellation and the effective date of the cancellation which may not be sooner than the day following service of the notice. Notice shall be served by delivering a copy to the permit holder or by leaving a copy at the permit holder's usual place of abode with some person of suitable age and discretion residing at that location. Conviction of a misdemeanor is not required to constitute a violation of law or ordinance for the purposes of this section.
(3) No permit may be issued for any location where, in the current or immediately preceding calendar year, a person has been convicted of a violation of this Chapter or a permit has been canceled. This provision does not apply to an applicant who was not associated in any way with the person who was convicted or permit that was canceled.
(4) No permit may be issued to a person who has had a license canceled in the current or immediately preceding calendar year or who has been convicted of a violation of this chapter or a related law or ordinance that occurred in the current or the immediately preceding calendar year.

5-2510 Request for Review. Any person who has been denied a permit or had a permit cancelled may request the City Manager or designee to review the decision. The request must be in writing and delivered to the City Manager’s office, or if not available to the City Police Department within 24 hours after being notified of the denial or cancellation. The City Manager or designee may approve the decision, overturn or overturn the decision with special conditions. No cancellation will take effect until after the decision of the City Manager or designee has been delivered to the applicant or permit holder which shall not be longer than 24 hours after receipt of the request for review.
