CHAPTER 5-800
CHRISTMAS TREE SALES

5-801 Application of Chapter 5-100. The provisions of Chapter 5-100 shall apply to the issuance of permits hereunder.

5-802 Permit Required. A permit shall be required for any person to display Christmas trees for sale.

5-803 Application. In addition to such information as the City Clerk may require pursuant to Section 5-102, the application shall also include:

(1) The location and size of the proposed display site.
(2) Certificate from the Zoning Administrator that the standards of Section 11-316 have been met, compliance with which are a condition precedent to the issuance of the permit.
(3) Assurances that the site of such display will be cleaned up within one (1) week after Christmas day. If the City Clerk deems it necessary, a performance bond may be required to assure compliance by the applicant.
(4) Written consent of owners of premises to the use of the property and their consent to assessment of costs as provided in Section 5-805.

5-804 Permit Fee. The permit fee shall be established from time to time by ordinance of the City Council; provided, however, if the applicant is a nonprofit organization, the fee shall be waived. 5-805 Assessing Costs of Cleanup. If the display site is not properly cleaned up within one (1) week after Christmas Day, the City may haul away the unsold trees, clean the premises, and assess the costs against the property.
