CHAPTER 7-100
GENERAL PROVISIONS

7-101 Assault. Whoever, in a violent, rude, angry, or insolent manner, touches or lays hands upon the person of another, commits an assault and is guilty of a misdemeanor.

7-102 Drinking on a Street. It shall be unlawful for any person to drink intoxicating or 3.2 percent malt liquor upon or within any premises not licensed for the sale or consumption of alcoholic beverage pursuant to City Code Chapter 5-200, except within the person’s private property or with permission of the owner of such premises. 7-103 Police Department Dogs. It shall be unlawful for any person to willfully or maliciously torture, torment, beat, or kick, strike, mutilate, injure, disable, or kill any dog used by the Police Department in the performance of the functions or duties of such department or to interfere or meddle with any such dog while being used by said department or any officer or member.

7-104 Sham Prizes and Discounts. No person shall pretend or make any award in any contest when the prize offered is of no value or is merely a pretended discount on the purchase of goods or services and the price on such purchase, with the pretended discount, is not substantially lower than the prevailing price.

7-105 Soliciting. Whoever shall solicit any kind of sale of goods or service by telephone shall, within the first one-half (1/2) minute of discussion disclose the true purpose of the call, the name of the caller, and the name of any company represented.

7-106 Threats Against Officer. Every person who shall directly or indirectly address any threat or intimidation to a public officer or to a referee, arbitrator, appraiser, or assessor, or to any other person authorized by law to hear or determine any controversy or matter with intent to induce him, contrary to his duty, to do or make or to omit or delay in any act, decision, or determination, shall be guilty of a misdemeanor.

7-107 Urinating in Public. Any person who urinates in a public place is guilty of a petty misdemeanor. “Public place” shall include any street, parking lot, sidewalk, mall, boulevard, park or other place open to public view, but shall not include enclosures designed for use as a toilet or restroom.

7-108 Trespassing on Public School Property.

(1) No person shall trespass in or upon any public school building or school property by remaining in or upon said school premises after being ordered to leave said building or property by a school official or police officer.
(2) No person having been ordered by a school official or police officer to leave a public school building or school property, and having left said premises, shall re-enter said public school building or school property without the written permission of the school principal or the police officer who gave the order to leave said premises.
(3) Any person who violates this section shall be guilty of a misdemeanor.

7-109 Trapping and Poisoning Animals and Birds. Except as provided herein, no person shall take, kill or injure or attempt to take, kill or injure any animal or bird anywhere in the City by use of traps, snares, poisons or similar devices or materials.

This provision shall not apply to the following:

(1) Property owners or occupants when eradicating destructive or nuisance wild animals on property they own or occupy.
(2) Agents of owners or occupants provided that the agent has on his or her person written authorization from the owner or occupant.
(3) Law enforcement officers and/or animal control officers acting within the scope of their duties.

Nothing in this section shall be construed as authorizing any act otherwise prohibited or regulated by Federal or State laws or local ordinances relating to animals.

Any person who violates this section is guilty of a misdemeanor.

7-110 Impounding Vehicles. Police officers lawfully seizing motor vehicles, as defined by Minnesota Statutes §169A.03, subd. 15, under Minnesota Statutes 169A.42, subdivision 1 may remove those vehicles to a storage facility or impound lot as may be designated by the City Manager or Chief of Police.
