CITY OF COON RAPIDS, MINNESOTA 8-701 Definitions. (1) “Vehicle” means every device
in, upon, or by which any person or property is or may be transported in or
drawn upon a highway, except devices moved by human power or used
exclusively upon stationary rails or tracks. 8-702 Custody of Unclaimed Motor Vehicles. The City Manager shall have the custody of motor vehicles not owned by the City which come into the lawful possession of the City and remain unclaimed by the owner. 8-703 Sale at Public Auction. After the unclaimed motor vehicle has been in the possession of the City for a period of at least 15 days from the mailing of notice to the registered owner, if any, the City may sell or authorize the sale of such vehicle at a public sale or auction. 8-704 Notice. The City shall, before the holding of the public sale or auction, mail to the registered owner, if any, as shown by the record of the State Registrar of Motor Vehicles, notice of its possession and intent to dispose of such motor vehicle. The City shall also cause to be published once in the legal newspaper notice of the public sale. Such notice shall describe generally the motor vehicle to be sold, the date, the time, and location of the sale. A public sale or auction shall not be held sooner than five (5) days after the date of publication. 8-705 Net Proceeds from Public Auction. The net proceeds of such sale shall be paid into the General Fund of the City. The net proceeds shall be the sale price less any costs of handling, storing, and selling such vehicle. 8-706 Owner of Unclaimed Motor Vehicle. The owner of the unclaimed motor vehicle sold at a public sale shall be paid the net proceeds of said sale thereof from the General Fund, if within six (6) months of the sale he makes application in writing and shows satisfactory proof of ownership. Such application shall be made to the City Manager.
